1. INTRODUCTION

Welcome to PostAgain ("we," "our," or "us"). These Terms and Conditions ("Terms") govern your access to and use of the PostAgain platform, including our website at PostAgain.com and all related services (collectively, the "Service").

PostAgain offers premium subscription plans ranging from €5 to €40 per month. We do not offer a free tier. Current pricing and features are available on our website.

4.2 Payment Terms

  • Subscription fees are charged in advance on a monthly basis
  • Payments are non-refundable
  • There will be no refunds for partial months of service
  • All fees are exclusive of all taxes, which are your responsibility

4.3 Subscription Changes

We reserve the right to change our subscription fees upon reasonable notice. Any price changes will take effect at the start of the next subscription period.

4.4 Cancellation

You may cancel your subscription at any time. Your cancellation will take effect at the end of your current billing cycle.

5. CONTENT AND CONDUCT

5.1 Your Content

You retain all rights to Content you submit, post, or display on or through the Service. By uploading Content to the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and distribute such Content on and through the Service.

5.2 Content Guidelines

You agree not to use the Service to:

  • Violate any applicable law or regulation
  • Infringe the intellectual property rights of others
  • Harass, abuse, or harm another person
  • Upload or transmit malware or other malicious code
  • Interfere with or disrupt the Service or servers connected to the Service

Our Service interfaces with third-party services such as Instagram, TikTok, and YouTube. Your use of these third-party services is governed by their respective terms of service and privacy policies.

We do not endorse or assume responsibility for any third-party content, products, or services.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL POSTAGAIN BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE
  • ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE

10. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless PostAgain and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

11. TERMINATION

11.1 Termination by You

You may terminate your Account at any time by following the instructions on our website or contacting our support team.

11.2 Termination by Us

We may terminate or suspend your Account immediately, without prior notice or liability, for any reason, including, without limitation, if you breach these Terms.

11.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination.

12. FUTURE AI CONTENT FEATURES

We may implement AI content creation features in the future. When these features are introduced, they will be governed by supplementary terms that will be made available at that time.

13. CHANGES TO THESE TERMS

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

14. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Paris, France.

15. DISPUTE RESOLUTION

Any dispute arising out of or in connection with these Terms, including any question regarding its existence, validity, or termination, shall be resolved by negotiation in good faith. If the dispute cannot be resolved by negotiation within 30 days, it shall be referred to and finally resolved by the competent courts of Paris, France.

16. SEVERABILITY

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

17. ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and PostAgain regarding our Service and supersede and replace any prior agreements we might have had between us regarding the Service.
